Welcome to Americanista™. The terms “we,” “us,” and “our” refer to Americanista™ and its legal operator, Green VieCom LLC. Americanista™ operates this website and online store, including its related information, content, features, and tools (collectively, the “Website”). The physical and digital goods offered for sale through the Website are referred to as the “Products.”
These terms and conditions, together with the policies referenced herein (collectively, these “Terms of Service” or “Terms”), describe your rights and responsibilities when you access or use the Website or purchase Products.
Please read these Terms carefully. They contain important information about your legal rights, including warranty disclaimers and limitations of liability. Nothing in these Terms excludes or limits rights or remedies that cannot lawfully be excluded or limited.

However, colors and product appearance may vary because of screen settings, device configuration, lighting, garment size, fabric texture, and normal production tolerances. Minor variations in print placement, scale, color, or texture do not necessarily constitute a defect.
Product photographs, mockups, and illustrations are provided to help present the product. The product delivered should materially conform to the description provided at the time of purchase, subject to normal production variations and applicable law.
Product descriptions, options, prices, and availability may change without notice. We may discontinue a product or limit the quantities offered to a person, geographic region, or jurisdiction, subject to applicable law.
Our designs are artistic and commemorative works inspired by history, heritage, memory, and storytelling. Unless expressly stated, our products are not official merchandise of, sponsored by, endorsed by, or affiliated with any government, tribal nation, historical institution, public figure, or other organization.
Nothing in this section limits any mandatory warranty, conformity, refund, or other consumer right available under applicable law.
SECTION 3 — ORDERS
When you place an order, you make an offer to purchase. An automated order confirmation acknowledges receipt of your order but does not necessarily constitute final acceptance. We may accept, decline, limit, or cancel an order for a legitimate reason, including suspected fraud, unauthorized payment, product unavailability, an obvious pricing or description error, shipping restrictions, or a violation of these Terms.
Payment must be authorized and processed before an order is accepted. Please review your order carefully before submitting it. Because an order may enter processing shortly after it is placed, we may be unable to accommodate a change or cancellation request.
If we decline or cancel an order after collecting payment, we will refund the applicable amount to the original payment method. We will attempt to notify you using the email address, billing address, or telephone number provided with the order.
Returns, exchanges, refunds, and cancellation requests are governed by our Return & Refund Policy, subject to any mandatory rights under applicable law.
Unless otherwise agreed in writing, Products purchased through the Website are intended for personal or household use and not for unauthorized commercial resale.
SECTION 4 — PRICES AND BILLING
Prices, discounts, and promotions may change without notice. The price charged will be the price displayed when the order is submitted and shown in the order confirmation, except in the case of an obvious pricing error. Unless expressly stated otherwise, displayed prices may exclude shipping, handling, customs duties, import charges, and applicable taxes.
Promotions may be governed by additional terms. If promotional terms conflict with these Terms, the promotional terms will apply to that promotion.
You agree to provide accurate and complete purchase, payment, and account information and to update it when necessary. You represent that you are authorized to use the payment method submitted and authorize the applicable charges shown at checkout.
International customers may be responsible for customs duties, import taxes, brokerage fees, or other charges imposed by the destination country unless expressly stated otherwise at checkout.
SECTION 5 — SHIPPING AND DELIVERY
Processing methods, shipping destinations, estimated delivery times, shipping charges, and other delivery information are described in our Shipping Policy.
Delivery dates are estimates unless we expressly confirm a guaranteed delivery date. Delivery may be affected by carriers, customs processing, weather, incorrect or incomplete addresses, high order volume, or other circumstances outside our reasonable control.
You are responsible for providing a complete and accurate delivery address. If you identify an address error, contact us promptly at support@americanista.com. We cannot guarantee that an address can be changed after processing begins.
If tracking indicates that a shipment may be lost, or if an item arrives damaged, please contact us promptly at support@americanista.com. We will review the matter with the carrier and determine the appropriate resolution under our Shipping Policy and Return & Refund Policy.
SECTION 6 — INTELLECTUAL PROPERTY
The Website and its content—including trademarks, brand elements, text, artwork, photographs, graphics, video, audio, and the selection and arrangement of such materials—are owned by or licensed to Americanista™ and are protected by applicable intellectual-property laws.
These Terms permit you to use the Website for personal, non-commercial purposes only. Except as permitted by law or with our prior written consent, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, scrape, or transmit material from the Website.
Purchasing a product does not transfer ownership of any artwork, trademark, copyright, or other intellectual-property right embodied in or associated with that product.
Americanista™’s names, logos, product names, designs, and slogans are trademarks or protected brand elements of Americanista™ or its licensors. Other names and marks displayed through the Website belong to their respective owners.
SECTION 7 — OPTIONAL TOOLS
We may provide access to tools offered by third parties that we do not monitor or control. To the extent permitted by law, access to such tools is provided “as is” and “as available,” without endorsement.

All purchases made through our store are transactions directly between you and Americanista™. Americanista™ is the seller and merchant of record and is responsible for accepting and processing orders, collecting payments, fulfilling products, providing customer service, and handling eligible cancellations, returns, exchanges, and refunds in accordance with these Terms, our published policies, and applicable law.
Technology, payment, production, fulfillment, delivery, analytics, and other operational service providers may assist us in operating the Website and fulfilling orders. Their involvement does not change Americanista™’s responsibility to you as the seller, except where applicable law expressly provides otherwise.
SECTION 10 — PRIVACY POLICY
Personal information collected through the Website is handled in accordance with our Privacy Policy.
We may use operational service providers to host, protect, process, support, and improve the Website and our order operations. Feedback must not violate another person’s intellectual-property, privacy, publicity, or other rights and must not be unlawful, defamatory, abusive, obscene, deceptive, or contain malicious code. Subject to applicable law, we may correct an error, update information, or cancel an affected order. If we cancel an order after payment has been collected, we will refund the applicable amount to the original payment method.

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, willful misconduct, gross negligence where it cannot be limited, death or personal injury caused by negligence where applicable, breach of mandatory consumer rights, or any other liability that cannot lawfully be excluded or limited.
Where liability cannot be excluded but may lawfully be limited, it will be limited to the maximum extent permitted by applicable law.

These Terms and any separate agreement relating to your use of the Website or purchase of Products are governed by the laws of Wyoming, United States, where Green VieCom LLC is established, without regard to conflict-of-law principles.
Nothing in this section deprives a consumer of mandatory protections or the right to bring a claim in a court or forum available under the law of the consumer’s place of residence where such rights apply.

Changes will not retroactively reduce rights relating to an order already accepted unless permitted by law.
