Americanista™ is an independent fashion brand that creates and sells its own products directly to customers. Our designs are researched, created, and developed by the Americanista™ creative team, drawing inspiration from documented history, cultural heritage, and real stories connected to Native American people. Americanista™ is not a marketplace, design-submission platform, or intermediary selling designs on behalf of third-party creators.

Americanista™ respects the intellectual property rights of artists, photographers, writers, designers, brands, communities, and other rights holders. Historical events, cultural traditions, community identities, and publicly available stories are not claimed as the property of Americanista™. Our rights apply to Americanista™'s original creative expression, including the specific artwork, graphics, wording, arrangements, photographs, product presentations, and other original materials we create.

Ownership of Americanista™ Content and Designs

Unless otherwise expressly stated, all original designs, artwork, graphics, logos, product photographs, product descriptions, and other original content displayed on this website are exclusively owned by Americanista™ or used by Americanista™under a valid license. Americanista™'s original designs and creative assets may not be copied, reproduced, modified, distributed, republished, manufactured, offered for sale, or used commercially without our prior written permission.

Authentic Americanista™ products are sold only through Americanista™'s official website and any sales channel that Americanista™ expressly identifies as authorized. Products offered through unauthorized third-party websites or sellers—including products that copy or misuse our photographs, artwork, or designs—are not sold, supplied, approved, or guaranteed by Americanista™. To the fullest extent permitted by applicable law, Americanista™ is not responsible for the quality, safety, fulfillment, refunds, losses, or other issues arising from purchases made through those unaffiliated sellers. Customers should contact the seller or payment provider used for that transaction. Suspected copies or unauthorized listings may be reported to support@americanista.com.

A. Reporting Intellectual Property Infringement

If you believe that content available on Americanista™'s website infringes your copyright, trademark, or other intellectual property rights, please send a written notice to:

Your notice should include:

• Your full legal name and, if applicable, the name of the organization or rights holder you represent.
• Identification of the copyrighted work, trademark, or other intellectual property that you believe has been infringed, including any applicable registration number.
• The exact URL of each Americanista™ webpage or product containing the material you are reporting.
• A clear description of the material you believe is infringing and an explanation of how it allegedly infringes your rights.
• Information or documentation reasonably sufficient to demonstrate that you own the relevant rights or are authorized to act on behalf of the rights holder.
• Your mailing address, telephone number, and email address.
• A statement that you have a good-faith belief that the disputed use is not authorized by the rights holder, its agent, or applicable law.
• A statement that the information in your notice is accurate and, under penalty of perjury, that you are the rights holder or are authorized to act on behalf of the rights holder.
• Your physical or electronic signature.

Please provide direct links to the specific material being reported rather than only linking to the Americanista™ homepage.

B. Review and Response

After receiving a complete, good-faith infringement report, Americanista™ will review the information provided in accordance with applicable law and our policies.

Depending on the circumstances, we may:

• Request additional information or supporting documentation;
• Remove or disable access to the reported content;
• Temporarily or permanently discontinue the sale of an affected product;
• Consult our creative team, relevant licensors, suppliers, or other parties for clarification;
• Decline to take action when a report is incomplete, unsupported, or does not reasonably establish an infringement claim; or
• Take other appropriate action consistent with applicable law.

Any action taken during our review is intended to address the reported concern and does not constitute an admission of infringement, liability, or wrongdoing.

C. Responses and Mistaken Claims

If a person or organization responsible for reported content believes that a claim resulted from a mistake, misidentification, valid authorization, license, or another lawful use, we may request supporting documentation before deciding whether the content should remain unavailable or be restored.

Americanista™ does not adjudicate ownership disputes between third parties. When a dispute cannot reasonably be resolved based on the information provided, the parties may need to seek independent legal advice or an appropriate legal determination.

D. False or Misleading Reports

Do not submit an infringement report containing information you know to be false, materially misleading, or submitted for an improper purpose. A person who knowingly misrepresents that content or activity is infringing may be responsible for resulting damages under applicable law.

E. Information Submitted With a Report

Information submitted in connection with an infringement report may be shared with the person or organization responsible for the reported content, our professional advisers, service providers, or relevant authorities when reasonably necessary to investigate or respond to the report.

Personal information will otherwise be handled in accordance with our Privacy Policy.
